Software Usage Agreement

1. Service Description

immobilienmakler.info provides hosted software for real estate teams to manage properties, units, contacts, landlord profiles, leases, utility statement preparation, sales mandates, marketing listings, inquiries, viewings, partner portal credentials, and optional calendar workflows.

2. Beta Status

The service may be provided as a beta. Beta functionality can be incomplete, changed without notice, or temporarily unavailable. Customers should verify critical workflows before relying on them operationally.

3. Customer Responsibilities

Customers are responsible for entering lawful and accurate data, assigning team permissions appropriately, maintaining their own professional advice workflows, and ensuring that imported or connected third-party data may lawfully be processed.

4. Data Storage

The application stores account, organization, property, contact, landlord, tenant, contract, marketing, calendar, billing, audit-log, and support/contact data as needed to provide the service. Sensitive partner portal credential values are encrypted or redacted according to the credential workflow. Calendar provider tokens must not be treated as production-ready unless the relevant integration is explicitly enabled with secure token storage.

5. Third-Party Integrations

Email delivery may be processed through Postmark. Payments may be processed through Stripe. AI features may use Aquila/2342.ai-compatible services. Calendar and portal workflows may connect to Google, Microsoft, or real estate portal interfaces where configured. Provider availability and terms are outside the direct control of the application.

6. Availability, Backups, and Exports

The service aims to keep user data available through the application and GDPR export workflows. Availability, backup, and retention commitments for paid production use should be defined in the applicable commercial agreement.

7. Legal and Professional Advice

The software supports documentation and workflow management. It does not provide legal, tax, valuation, brokerage, accounting, or property-management advice.

8. Termination

Access may be terminated according to the applicable plan, contract, or beta terms. Data export and deletion workflows remain subject to legal retention duties and technical feasibility.

9. Governing Law

Unless a separate agreement states otherwise, German law applies to the extent permitted by law.
